Delta-8 THC occurs naturally in cannabis at trace concentrations (<0.1%), so commercial products are manufactured by acid-catalyzed isomerization of CBD extracted from legal hemp. This chemical conversion process — typically using sulfuric acid, p-toluenesulfonic acid, or Lewis acids in organic solvents — produces not only delta-8 THC but also uncharacterized byproducts including delta-10 THC, exo-THC, delta-6a(10a)-THC, and other isomers whose toxicological profiles are completely unknown. Independent testing by the US Cannabis Council and state laboratories has found residual solvents, heavy metals, bleaching chemicals, and unidentified reaction byproducts in the majority of delta-8 products tested. A 2021 analysis by the USCC found that only 38% of tested delta-8 products were accurately labeled for THC content. The FDA has received over 100 adverse event reports and issued consumer warnings, but has not established regulatory authority over hemp-derived cannabinoids.
